			<content:encoded><![CDATA[<p>The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 has been considered the biggest change to bankruptcy law in the prior 25 years. The new bankruptcy 2005 law did not make significant changes to Chapter 11 bankruptcy, the most common form of bankruptcy for business. However, it made major changes to Chapter 7 and Chapter 11 bankruptcy.</p>
<p>The 2005 bankruptcy law introduced the requirement for credit counseling in an attempt to find solutions for debtors before they filed bankruptcy. The law increased the liability of bankruptcy attorneys. When attorneys were found to file inaccurate cases or accused of fraud, the attorney faced fines. As a result, many attorneys raised their filing fees to cover the increased liability insurance premiums. The law also required financial education for those filing bankruptcy, even if the circumstances driving it were through no fault of their own. And the bankruptcy court required IRS tax forms as proof of stated income, no longer accepting stated income on bankruptcy filings.</p>
<p>Chapter 13 bankruptcy involves a payment plan to repay debt. The repayment plan typically ranges from three to five years. Chapter 13 bankruptcy is the only option for those who want to continue making payments to a creditor in order to keep non-exempt property, whether it is a highly valued house or a car. The 2005 bankruptcy law mandated income testing and means testing that pushed many people into Chapter 13 bankruptcy who would have previously filed Chapter 7. The income test compares the filer’s income to the median income of their state. The means testing also looks at how much money the person has after necessary payments such as rent, food, child support, taxes, health insurance, utilities and frequently vehicle payments. Child support and alimony became higher priorities over creditors in the new bankruptcy law. Internal Revenue Service (IRS) allowances are used to determine the amount required to live off of, not the person’s assumed amounts. The living allowance is based on family size, so larger families do receive a larger allowance. In many states such as Texas and Florida, a primary residence could not be seized in bankruptcy in most cases. The 2005 bankruptcy law makes the lower federal homestead exemption amount the primary one unless someone lived in the state for at least two years. Moving to a state with more friendly bankruptcy exemptions shortly before declaring bankruptcy was likely rare, but now this supposed loophole was no longer available. If the home had been bought within 40 months of filing, the filer could only exempt up to $125,000 of home value from the bankruptcy. For someone with a home below this value, they got to keep it in most cases. They could, of course, offer to sell the home in bankruptcy and move in with family or rent somewhere else cheaper. But the new 2005 bankruptcy meant that many people with very valuable homes found that bankruptcy meant selling it.
